General Terms and Conditions
3.1 Scope and contact
These terms govern the use of the Athlete Advisors platform, operated by Bertenghi & Partner AG, Seestrasse 6, 8002 Zurich, email info@athlete-advisors.com (the “Operator”). By using the platform, users agree to these terms.
3.2 Platform service
Athlete Advisors is a curated matchmaking platform that brings athletes (demand) together with vetted Solution Partners (supply) through topic-based matching. The Operator itself does not provide advisory, insurance, tax, legal or other professional services; these are provided exclusively by the Solution Partners. Any contract for such services is concluded solely between the athlete and the Solution Partner.
3.3 Roles
- Athletes use the platform free of charge, may explore the marketplace and onboarding anonymously, and remain pseudonymous until a Solution Partner accepts their request.
- Solution Partners receive qualified requests as part of their membership; upon accepting a request, the identity and contact details of both sides are mutually disclosed.
- Professional Access (advisors) supports several athletes and can, with their consent, start requests on their behalf.
3.4 Anonymity and mutual disclosure upon acceptance
Athlete and Solution Partner remain mutually anonymous until the partner accepts the request. Upon acceptance, the identity and contact details of both sides are disclosed to exactly this one partner. By submitting the request, the athlete consents to this mutual disclosure in the event of acceptance. Athletes may use the marketplace and onboarding without an account and without disclosing their identity (anonymous); to submit a request they create an account with an email address. The Operator does not perform any ID or identity check. Technical anonymity vis-à-vis third parties outside the platform is not guaranteed.
3.5 Prices and conditions
Use of the platform is free of charge for athletes. Solution Partners pay a pure annual membership; individually agreed conditions (e.g. staggered by specialty) are set bilaterally between the Operator and the Solution Partner. There is no per-request billing; the number of requests has no effect on the membership price. Within the Kickstart offer the first year is free of charge; from the second year the respective agreed membership applies. For Professional Access separately agreed conditions apply. All prices are in CHF, plus statutory VAT where applicable.
3.6 Conclusion of contract and payment
Paid services of Solution Partners or Professional Access towards the Operator (membership as well as any booked add-ons) are billed via the platform. Payments are processed through the Operator's payment service provider; the Operator itself does not store any bank or payment data of Solution Partners or Professional Access.
3.7 User obligations
Users provide truthful information, do not misuse the platform and respect the anonymity of athletes. Solution Partners deliver their services professionally and within the scope of their applicable authorisations.
3.8 No guarantee of success
The Operator guarantees neither that a match will come about nor any particular outcome of the mediated services.
3.9 Liability
The Operator is not liable for the services of the Solution Partners. Otherwise, liability is — to the extent permitted by law — limited to intent and gross negligence.
3.10 Termination
Usage relationships may be terminated in accordance with the periods stated on the platform. The Operator may suspend accounts in the event of breaches of these terms.
3.11 Applicable law and place of jurisdiction
Swiss law applies exclusively. Place of jurisdiction is, to the extent permitted by law, Zurich.
